Are Nicotine Pouches Legal in Ireland? 2026 Rules

Yes. Tobacco-free nicotine pouches are legal to buy and use in Ireland as of 17 October 2026. They are not yet covered by the same laws as tobacco products. Tobacco snus, which contains powdered tobacco, cannot be bought legally. A Government Bill that would add an under-18 sales ban and advertising limits for pouches is still before the Oireachtas.

This page separates current law from proposed law. It also covers snus, vapes, price, health and what changes if the Bill passes.

TL;DR

  • Tobacco-free nicotine pouches are legal to sell and use in Ireland today. The HSE and parliamentary answers place them outside the tobacco laws for now.
  • Tobacco snus (powdered tobacco) cannot be bought legally in Ireland. Nicotine pouches are a different product.
  • Bill 36 of 2026 would ban sales to under-18s, point-of-sale display in mixed retail shops and retail advertising. It is not enacted yet.
  • The HSE says pouches are not harm-free. Treat them as a nicotine product, not a health product.
  • Expect about €7 to €10 per tin, going by September 2026 Irish reporting. Brands and promotions vary.

What the law says today

There is no Irish law that bans nicotine pouches. There is also no law that specifically regulates them. In a November 2025 parliamentary answer, nicotine pouches were described as a gap the Government wanted to close by adding baseline measures to its draft tobacco and nicotine bill.

In practice:

  • Adults can buy and use tobacco-free pouches.
  • Shops, petrol stations and online stores can sell them.
  • No national age limit for pouches is in force yet. Responsible sellers set their own adult-only policy.
  • Pouches are not covered by the smoke-free workplace rules, because they produce no smoke or vapour. Venues and employers can still set their own rules.

The gap is the reason for the Bill. Policymakers want new recreational nicotine products to meet baseline child-protection rules even when they contain no tobacco and are not inhaled.

Nicotine pouches and snus are not the same thing

People in Ireland often say “snus” when they mean a pouch. The law does not treat them alike.

Tobacco snus Nicotine pouch
Contains tobacco Yes, powdered tobacco No
Source of nicotine Tobacco leaf Made in a laboratory
Legal to buy in Ireland No Yes, currently
Covered by tobacco laws Yes Not yet

The HSE describes pouches as small pouches of powder with lab-made nicotine, flavourings, sweeteners and fillers. You place one between your lip and gum. A pouch labelled as tobacco-free “snus” is a pouch. A product with tobacco in it is the one that is not allowed.

If you search for “Irish snus” or “strong snus in Ireland”, this is what you want to check: does the tin say tobacco-free? If it does not, do not buy it.

What Bill 36 of 2026 would change

The Public Health (Tobacco Products and Nicotine Inhaling Products) (Amendment) Bill 2026 creates a new category: nicotine consumption products. It covers pouches and future non-medical products meant for recreational nicotine use.

The proposed controls:

  1. No sale to anyone under 18.
  2. No point-of-sale display in mixed retail shops.
  3. No retail advertising, including online retail advertising and free distribution.

The Bill digest covers the wider package, including rules for e-cigarettes. Most of that package concerns vapes, not pouches.

Where the Bill stands

The Oireachtas page was updated on 14 October 2026. It records Seanad Third Stage. It shows no enactment date. So as of 17 October 2026:

  • The Bill is not law.
  • The age limit, display ban and advertising ban do not apply to pouches yet.
  • Commencement can come after enactment, so the rules may start later than the signing date.

Check the Bill page for the latest status before you rely on this section.

Why the Government is acting

The concern is young people and fast market growth. The parliamentary material cites about 1% of adults currently using pouches, 3% of 15 to 24-year-olds and 4% of Irish 15 and 16-year-olds in the 2024 ESPAD study, according to the Bill digest. Those figures explain the proposal. They do not say that every adult user is a young user.

Reported pouch use across three age groups

In the Seanad, the Minister said the Bill’s purpose is to reduce the appeal and accessibility of e-cigarettes, vapes and other nicotine products, including pouches, especially for young people.

Licensing: does it apply to pouches?

The HSE runs a retail licensing system for tobacco and nicotine inhaling products. It includes online sales. Published annual fees are €1,000 for tobacco only, €800 for nicotine inhaling products only and €1,800 for both. Licences last 12 months, and online sellers must show the licence number on their website.

That regime covers statutory product categories. Do not assume it settles the status of tobacco-free pouches before Bill 36 commences. The 2023 Act applies to tobacco products and nicotine inhaling products. Bill 36 proposes to extend baseline controls to oral nicotine products like pouches.

The point for a buyer: a product can be legal and still face new rules soon. Legal today does not mean unregulated forever.

People who ask “can you vape in Ireland?” often also ask about pouches. The answers differ.

  • Reusable vapes: legal to sell and use, as a regulated inhaled product. Venue rules on where you may vape apply.
  • Single-use vapes: the Public Health (Single-Use Vapes) Act 2026 prohibits their sale in the State. It is not a general ban on reusable vaping products.
  • Pouches: no smoke, no vapour. A pouch is not vaping and not smoking. It is a separate category.

If you are a vaper looking at pouches because of the single-use ban, the legal position is simple. Pouches are not caught by that Act.

Health: what the HSE says

Legal does not mean safe. The HSE says pouches are not harm-free, can contain high nicotine levels, and that long-term risks are unknown. It lists possible effects:

  • increased heart rate and blood pressure
  • sleep problems
  • anxiety
  • mouth problems
  • nausea and dry mouth
  • nicotine poisoning

A 2025 peer-reviewed review calls pouches non-combustible and tobacco-free, but not risk-free. It says pouches may expose users to fewer toxicants than cigarettes. It also lists concerns: nicotine addiction, youth uptake, dual use and uncertain long-term oral and cardiovascular effects. Nicotine content across studied products ranged from 1 to 47 mg per pouch. That is a research range, not a permitted Irish strength.

What this means if you smoke:

  • Pouches remove smoke and combustion. They are not an approved quit aid.
  • If you want to stop nicotine completely, talk to your GP, pharmacist or the HSE quit service about licensed options.
  • If you have a heart condition, are pregnant or have mouth problems, speak to a doctor before you use any nicotine product.
  • Start with a lower strength. Do not use several pouches at once.

How much do nicotine pouches cost in Ireland?

Irish reporting in September 2026 said tins commonly sell for about €7 to €10. That is a market figure, not an official price. Brand, pouch count, strength, delivery and promotions change the total.

The same report cites 2025 Healthy Ireland figures: 1% of the population currently uses pouches and 6% has tried them and stopped. It also notes that a ban on selling cigarettes and vapes at temporary premises, such as pop-up stalls at events, leaves a gap that still lets pouches be sold and promoted.

Buying checklist for Irish adults

  1. Adults only. Do not buy for anyone under 18, even though no pouch age limit is in force yet.
  2. Tobacco-free. Check the tin. Tobacco snus is not legal to buy here.
  3. Strength. Match it to your use. Higher strength means more nicotine in the mouth.
  4. Flavour life. Some pouches lose flavour fast. Others last 30 to 60 minutes.
  5. Delivery. Check cut-off times and counties before you order.
  6. Storage. Keep tins away from children and pets.
  7. Disposal. Used pouches go in the bin, not on the ground.

Our view

We are an Irish-owned company. We make pouches for adults in Ireland, and we want clear rules.

We see three things:

  • Clear age rules help. Nicotine pouches are for adult nicotine users. A national under-18 ban gives everyone one standard.
  • Quality matters. Our pouches use a rapid-release, low-drip design. Nicotine comes out quickly and smoothly, without the drip many users dislike. Flavour lasts 30 to 60 minutes.
  • Honesty matters. We do not call pouches safe. They contain nicotine. If you do not use nicotine, do not start.

We will follow the final text of Bill 36 once it is enacted and commenced.

What to watch next

Three things can change the answer on this page:

  • Enactment and commencement of Bill 36. Watch the Oireachtas page for an enactment date.
  • Regulations. The Bill proposes rules on display and advertising. Detail may follow in regulations.
  • Retail changes. Mixed retail shops would have to remove pouch displays. Online shops would face advertising limits.

Until then, current law applies: tobacco-free pouches are legal, tobacco snus is not.

FAQ

Yes, tobacco-free pouches are legal to sell and use for adults as of 17 October 2026. They are not yet regulated under tobacco control law. A Bill to add an under-18 sales ban is before the Oireachtas.

Tobacco snus is not legal to buy in Ireland. Tobacco-free nicotine pouches, which people often call snus, are legal. Check that the tin says tobacco-free.

Can you vape in Ireland?

Yes, with limits. Reusable vapes are legal and regulated, with venue-specific rules. The Single-Use Vapes Act 2026 bans the sale of single-use vapes. Pouches produce no vapour, so they are not vaping.

How much are nicotine pouches?

Irish reporting in September 2026 put tins at about €7 to €10. Strength, pouch count, brand and delivery change the total.

Can under-18s buy nicotine pouches in Ireland?

No national age limit for pouches is in force yet, so the law does not currently stop a sale. Bill 36 would ban it. We sell to adults only, and every responsible seller should do the same.
